A ratio decides how many staff a room needs; the group size caps how many children may be in it.

Nap time splits by age: groups of 12 months and under need every staff member required to meet the ratio in the sleep area, while for older children at least one qualified staff member stays in each nap area with the remaining ratio staff on the premises and within calling distance.

Student interns get a defined exception: one aged 17 or older who is a Youth Apprentice in the second year of the West Virginia Department of Education's Child Development Specialist program counts in ratio but may not work alone.

West Virginia defines a child care center as care for 13 or more children, if the facility is open for more than 30 days per year per child; below that line, home-based care runs as a licensed family child care facility under 78CSR18 or a registered family child care home under 78CSR19.

A registered home may care for no more than six children under 13 at any one time, with no more than two under 24 months, and resident and visiting children under 6 count toward the cap.

A licensed family child care facility serves more children than a registered home but fewer than 13, and it must have two staff members on duty whenever it cares for more than two children under 24 months or more than six children at the same time.
